Cocaine Charges

So that you can have the best chance of beating a cocaine possession and even a trafficking charge, keep in mind the following:

• Charges you face – You could be looking at a number of drug related scenarios, none of which are particularly positive. For instance, possession of cocaine will be charged as a Class A Misdemeanor at least. This means up to one year behind bars and thousands of dollars in fines. If you’ve had a previous arrest and conviction for distribution or the manufacturing of the drug, you could be hit with  third degree felony charges. If you are within 1000 feet of many structures it can be charged as a third degree felony. That translates to up to possibly 5 years behind bars and up to $9,500 in fines. Cocaine distribution when deemed a serious case can mean first degree felony charges. You could get up to life in prison and nearly $20k in fines.
• Also a conviction will result in a loss of your driver’s license.
• Defense options – In presenting your defense case to the court, you and your criminal defense attorney should look at several options. One is the drugs found in your possession were not yours. If you unknowingly had them in your possession, the argument can be made they were possibly planted there by someone you know or even a stranger. Another defense to look at is search and seizure. Did law enforcement do everything by the book with your arrest? If not, a technicality could leave you an opening.
